Olympia – On May
17, 2005 the Washington State Liquor Control Board notified the owner
of Bob’s Burger and Brew in Ferndale of a 37-day liquor license
suspension scheduled to go into effect at 10 a.m. on June 20, 2005.
The owner of the business has until June 6, 2005 to challenge the
suspension.
The suspension is being
issued for serving alcohol to a customer who was apparently
intoxicated. After drinking heavily at the business May 17, 2004, a
customer drove his car to the Peace Arch border crossing where he
collided with a waiting vehicle, seriously injuring several passengers
in that vehicle. The driver’s blood alcohol level was .240 — three
times the legal limit for driving a vehicle. He was convicted of three
counts of vehicular assault last November.
Liquor enforcement
officers who conducted an investigation at Bob’s Burger and Brew
following the accident found the customer had purchased 11 alcoholic
beverages at the premises and was drinking with the owner, Michael
Kildall, shortly before the collision. Investigation of the incident
took an unusually long time because the owner misrepresented facts
about the incident, according to the investigating officers.
The owner may choose to
accept the suspension, request a settlement conference with the
Board’s regional enforcement manager, or request an administrative
hearing. If he fails to challenge the liquor license suspension, it
will go into effect as scheduled.
