Business faces a 30-day liquor license suspension
OLYMPIA - McCabe's American Music Cafe in Tacoma was cited for alcohol
violations following a joint undercover operation conducted on March 21 by
the Washington State Liquor Control Board (WSLCB) and the Tacoma Police
Department. The establishment, located at 2611 Pacific Ave., faces a 30-day
suspension of its liquor license, scheduled to begin at 4 p.m. on Thursday,
May 14, 2009 and end at 4 p.m. on Saturday, June 13, 2009.
Liquor enforcement and police officers checked 10 Tacoma businesses for
sales/service of alcohol to minors, sales/service of alcohol to apparently
intoxicated persons, and allowing disorderly conduct on the licensed
premises during the undercover operation.
McCabe's was cited for three counts of allowing an apparently intoxicated
person to possess/consume alcohol. The 30-day suspension is considered an
aggravated penalty. McCabe's also received a written warning for disorderly
conduct by an employee of the liquor licensed establishment.
The WSLCB decided in October 2008 to pursue non-renewal of McCabe's liquor
license. McCabe's has requested a hearing regarding the decision before an
administrative law judge from the Office of Administrative Hearings. The
hearing is scheduled for June 2009.
The WSLCB and local authorities regularly conduct undercover operations at
area businesses licensed to sell alcohol. These businesses include spirits,
beer and wine restaurants, grocery stores, neighborhood markets, taverns,
wine bars and sports/entertainment facilities.
Liquor enforcement officers are empowered to issue Administrative Violation
Notices to businesses that violate state liquor laws and regulations. Fines
or temporary license suspensions can be issued depending on the severity of
the infraction or the frequency with which a business has been cited. Liquor
enforcement officers review the past two years when determining fines or
license suspensions.
